To be honest, awhile back when I was admin I made a call to ban an unknown hacker on the server who was lagging it in the middle of the night. I had no proof of it, but I did know everyone else except for one other person in the server. I kicked the person and the lag stopped, then when he came back, I banned him, and no more lag.
So sometimes you can't have proof unless you have zero look it up himself, but if you happen to figure it out on your own then its all good. But next time, remember kicking can stop hackers long enough for you to figure out who it is.
And no Turtle, they don't.

I find people's frustration and failure quite funny... after all it's all just a game... you'll die early if you take it too seriously. ^^
