Personally, I think the fool should be replaced with either a VT or a doctor of some kind--even a bodyguard would work. 4 scum, 6 town and a 3rd party is a bit rough.

If fool does not end the game then it is a useless role.

Game ending Fool is an amazing tool IF it's known beforehand. It's a non-broken third party with a fairly easy win con. It makes claiming more interesting. It force both sides to play intelligently before lynching. Oh I think I see the problem now.

The same can be said for any number of things, a N0 kill for example. It's also why I specified a known fool. An unknown fool ending a game comes from left field. Losing to a known fool means you got outplayed. Exactly like any other mislynch. The main difference is even scum are susceptible to this mislynch.
But, put simply, if people don't like it, avoid games with it, or avoid running games with it.
